1.GENERAL PROVISIONS
1.1. purchasing rights are a legal document identifying the following: the rights of the seller and the buyer, purchasing and payment conditions, delivery and returns conditions, responsibility of the buyer & seller and all the other conditions related to “MACKIS” online store
1.2. The buyer, when putchasing our products online, agrees to these terms and conditions
1.3. the purchasing agreement between the buyer and the seller becomes bonding once the buyer clicks the button to purchase the product (at that point the shipping address is provided as well as the billing information is filled out)
2. Privacy policies
2.1. A buyer must provide the following personal information when shopping online at “mackis”: First name, last name, address and an e-mail.
2.2 a buyer is responsible for providing the right and correct personal information.
2.3. a buyer agrees that the personal information provided will be used only for placing that particular order. a buyer also agrees to receive e-mails from “mackis”, related to that particular purchase.
2.4. personal information provided by the buyer can be used for marketing purposes, only if the buyer agrees to it.
2.5. the seller agrees to keep the personal information secure, not releasing it to any 3rd party. Only exception to this is if the asking 3rd party is a government agency or if the buyer gives a written permission allowing it.
3. the rights and liabilities of the buyer
3.1. the buyer is liable for paying for the ordered items and for receiving them.
3.2. the buyer is liable to provide the seller with the right personal information. if the information provided is incorrect, “mackis” has the right to cancel the order and delete all the provided information.
3.3. if the provided information needs to be changed, the buyer must notify the seller immediately.
3.4. the buyer has the right to cancel the purchasing order by following the steps listed in the “returns and exchange policy”.
3.5. the buyer, shopping at “mackis” store online, agrees to these purchasing policies as well as the rules and regulations governed by the law of the republic of lithuania.
4. Seller rights
4.1. It is the seller’s responsibility to create the right conditions for the buyers to shop at “mackis” online store.
4.2. if the buyer does not follow his/hers responsibilities and the rules and regulations of the online store, the seller has the right to cancel any orders placed and terminate the buyer from using the online store
4.3. the seller is responsible for protecting the buyers’ privacy and not disclosing it to any 3rd party.
4.4. the buyer is responsible for delivering the purchased items to the buyer
4.5. the seller has the right to close the online store at anytime, without any prior notification
4.6. the seller has the right to change the policies listed here at anytime
4.7. a buyer automatically agrees to the new terms and conditions if the buyer continues to use the online store after the policies were changed
5. terms and conditions for placing orders, pricing and payments
5.1. “mackis” online store is open 7 days a week, 24 hours a day
5.2. orders are taken only if the buyer is using the online store
5.3. online store prices are listed in euros, taxes included
5.4. once the items are purchased, a buyer is responsible to make a payment within 2 calendar days. The order gets shipped only once the payment is made.
5.5. if the buyer fails to make a payment within 2 calendar days, the order is cancelled.
6. shipping policies
6.1. It is the buyers responsibility to provide the seller with the right shipping address
6.2. the buyer is responsible for accepting the delivery of the purchased item. the seller is not liable if the buyer is unable to receive the shipped item, and someone else at the right address provided accepts the package.
6.3. once the payment is made, the purchased items get shipped within 2 business days.
6.4. the seller is not liable if the purchased items are not delivered at the time convenient for the buyer, or if the purchased items do not get delivered due to the buyer’s fault.
6.5. it is the buyer’s responsibility to notify the seller immediately if the delivered package contains the wrong order or if the package is damaged.
6.6. it is the buyer’s responsibility to send a notifying e-mail (pictures included) to the seller, once the wrong or damaged packaged is delivered
7. Warranty and Conditions
7.1. full item description is listed for every product sold at “mackis” online store
7.2. the quantity of items showed in the images posted at the “mackis” online store do not NECESSARILY reflect the price listed under the image – the prices listed are for one single item. coloring of the items for each buyer may slightly vary due to the differences in computer monitors used by each buyer.
7.3. a warranty guaranteed for each online store product, is listed in the product description.
8. promotions and other information
8.1. the seller at “mackis” online store has the right to organize any sales and promotions
8.2. the seller has the right to cancel or change any sale or promotion. The changes go in effect as soon as they are made.
8.3. the seller communicates with the buyer and sends any necessary information to him/her via e-mail provided in the order form.
8.4. the buyer communicates with the seller via the contact information listed on the “mackis” online store website
8.5. the seller is not liable if the buyer does not receive the e-mails due to any technical problems coming from the buyer’s side.
8.6. personal information of the buyer can be used for marketing purposes, only as indicated in the “privacy policies”
9. FInal provisions
9.1. Purchasing Rights are in accordance with the rules and regulations of the government of the republic of lithuania.
9.2. the above mentioned policies are regulated by the government of the republic of lithuania. Any questions or issues raised by these policies can be negotiated directly with the seller. In case of failed negotiations, any issues will be solved in the court of law of the republic of lithuania.
